What Is a Class Action Lawsuit?

Filing and fighting a lawsuit can cost a great deal of money. For the average person, that can place justice out of their reach. But if that person becomes a part of a class (a group of similarly situated people), if the class can find a lawyer willing to finance and litigate a lawsuit, then all members of the class have a chance to right a wrong.

That is a class action lawsuit — a lawsuit brought on behalf of many similarly situated people who have been harmed in the same way by the same entity.

Usually class action litigation will have very few named plaintiffs (one or two is common), but those plaintiffs represent many other people — hundreds, thousands, sometimes millions of people.

Class action lawsuits: Small claims multiplied by many people

The harm done to one person may amount to a relatively small amount of money — an extra $10 fee when you buy a product or service, for example. Birth Control Pills Containing Drospirenone: Possible Increased Risk of Blood Clots

The FDA is concerned about the potential increased risk of blood clots when using drospirenone-containing birth control pills. The 2011 studies have shown an almost one and one-half increase in the risk of blood clots for women who use these birth control pills.

Brand names of drospirenone-containing products include Yaz (generics Gianvi and Loryna), Yasmin (generics Ocella, Syeda, and Zarah), Beyaz and Safyral.

Zofran (ondansetron) - Risk of Abnormal Heart Rhythms

The FDA notified healthcare professionals and patients on September 15, 2011, "[O]f an ongoing safety review and labeling changes for the anti-nausea drug Zofran (ondansetron, ondansetron hydrochloride and generics). Ondansetron may increase the risk of developing prolongation of the QT interval of the electrocardiogram, which can lead to an abnormal and potentially fatal heart rhythm, including Torsade de Pointes. Patients at particular risk for developing Torsade de Pointes include those with underlying heart conditions, such as congenital long QT syndrome, those who are predisposed to low levels of potassium and magnesium in the blood, and those taking other medications that lead to QT prolongation." Celexa: Abnormal Heart Rhythms Associated With High Doses

The FDA has warned healthcare professionals and patients, "The antidepressant Celexa (citalopram hydrobromide) should no longer be used at doses greater than 40 mg per day because it can cause abnormal changes in the electrical activity of the heart. Changes in the electrical activity of the heart (prolongation of the QT interval of the electrocardiogram [ECG]) can lead to an abnormal heart rhythm (including Torsade de Pointes), which can be fatal. Patients at particular risk for developing prolongation of the QT interval include those with underlying heart conditions and those who are predisposed to low levels of potassium and magnesium in the blood." Diflucan Warning by FDA: Birth Defects Possible When Taken During First Trimester

The FDA reported on August 3, 2011, "FDA is informing the public that treatment with chronic, high doses (400-800mg/day) of Diflucan (fluconazole) during the first trimester of pregnancy may be associated with a rare and distinct set of birth defects in infants. This risk does not appear to be associated with a single, low dose of fluconazole 150mg to treat vaginal yeast infection (candidiasis). Based on this information, the pregnancy category for fluconazole indications (other than vaginal candidiasis) has been changed from category C to category D. The pregnancy category for a single, low dose of fluconazole has not changed and remains category C." FDA Warns About Zocor, Simvastatin, Vytorin and Simcor

The FDA announced this week that patients taking Zocor (also known as Simvastatin, Vytorin and Simcor), are not to take more than 80 mg due to the risk of myopathy and rhabdomyolysis—rare forms of muscle injury. Rhabdomyolysis can cause kidney damage as well as muscle damage. If you have taken any of these drugs in a dosage greater than 80 mg please contact us.

The FDA report states, "FDA notified healthcare professionals that it is recommending limiting the use of the highest approved dose of the cholesterol-lowering medication simvastatin (80 mg) because of increased risk of muscle damage. Patients taking simvastatin 80 mg daily have an increased risk of myopathy compared to patients taking lower doses of this drug or other drugs in the same class. This risk appears to be higher during the first year of treatment, is often the result of interactions with certain medicines, and is frequently associated with a genetic predisposition toward simvastatin-related myopathy. The most serious form of myopathy, called rhabdomyolysis, can damage the kidneys and lead to kidney failure which can be fatal. FDA is requiring changes to the simvastatin label to add new contraindications (should not be used with certain medications) and dose limitations for using simvastatin with certain medicines."

The FDA is advising consumers not to consume Slim Forte Slimming Capsule and Slim Forte Double Power Slimming Capsules. If you have, please contact us. These products contain sibutramine which was removed from the U.S. market. The FDA reports, "Sibutramine is known to substantially increase blood pressure and/or pulse rate in some patients and may present a significant risk for patients with a history of coronary artery disease, congestive heart failure, arrhythmias, or stroke. These products may also interact in life threatening ways with other medications a consumer may be taking." Children's Motrin

Bloomberg News reported that Johnson & Johnson's McNeil Consumer Products unit must pay $10 million for a child who "took Children's Motrin [ibuprofen] to treat a fever and cough" in 2000. The Motrin caused the child to be "blind in one eye and suffered burns over 84 percent of her body." The ruling "means that 'J&J and McNeil will be called to task' for failing to properly warn parents about Motrin's risks." Darvocet / Darvon

If you have taken Darvocet or Darvon please contact us. Darvocet and Darvon have been marketed, according to the FDA, "in the United States since 1976 as a Schedule IV Controlled Substances used as either a single ingredient (e.g., Darvon) or in combination with acetaminophen (e.g., Darvocet) to treat mild to moderate pain. There have been several reviews of these drugs. In light of new scientific findings, the "FDA determined the post-marketing safety signals for this drug have taken on new importance, and the overall balance of risk and benefit can no longer be considered favorable. The agency is recommending that propoxyphene [Darvocet/Darvon] products be removed from the US market." Please provide your information for an evaluation .

Adcetris Gets Black Box Warning

The FDA notified healthcare professionals that cases of a rare but serious brain infection that can result in death have been reported with the lymphoma drug Adcetris (brentuximab vedotin). Due to the serious nature of the infection, a new Boxed Warning highlighting this risk has been added to the drug label. In addition, a new Contraindication warning was added against use of Adcetris with the cancer drug bleomycin due to increased risk of pulmonary (lung) toxicity.
